TERMS AND CONDITIONS

You must be over the age of 21 to book your event at Ballroom Surge. You will be required to provide a valid ID. Ballroom Surge has a strict 21 and up policy. The Renter and Renter’s attendees must be 21 years of age or older. Minors must be accompanied by a parent or legal guardian.

Renter is allowed 1 scheduled tour to the venue. Renter is also allowed 1 scheduled final walkthrough to the venue prior to the rented date for event planning purposes.

The time slots reserved include set up and clean up time. Outside deliveries from all vendors or guests must be done within the rental time frame. Delivery trucks and U-Hauls are not allowed to be parked in the parking lot prior to event start time. For Saturday daytime events, Ballroom Surge staff will enter the facility at event end time (4:00pm) and begin the breakdown process for trash removal, cleaning, disinfecting, and preparing for the next client’s evening event.

Events exceeding the rented time by having guests or vendors in the facility past the rented time will result in hourly charges as shown in the Security Deposit Agreement.

There is a $150 non-negotiable cleaning fee automatically added to each rental, and it includes removing trash bags from the facility, breaking down tables and chairs, cleaning of floors and restrooms, and disinfecting contact surfaces. Additional charges may be applied towards the security deposit if terms are not followed in the Security Deposit Agreement.

Once you make the 50% deposit you have entered a binding agreement with Ballroom Surge.

The 50% deposit goes towards your rental and is non-refundable, with no exceptions. The remaining balance is due on or before 14 days prior to your event date. If unpaid, the card on file will be charged on the 13th day prior to your event date. Ballroom Surge must be notified of cancellations or requests for date transfer at least 30 days prior to your event start date, with no exceptions. Ballroom Surge has the right to cancel your event for non-payment 13 days prior to your event date for an unpaid balance.

The $150 cleaning fee charged at time of booking includes removal of trash bags, breaking down of tables and chairs, and cleaning of restrooms and contact surfaces. Additional charges may be taken from the security deposit if violations are made through the Security Deposit Agreement signed separately. The Security Deposit Agreement is attached to your invoice under “View Required Documents”. Ballroom Surge reserves the right to cancel a rental if the Security Deposit Agreement is not signed. The 

Fees pending until staff return to the space to check for cleanliness, damage, missing items, indoor smoking, etc. 

DEPOSIT AND CANCELATIONS 

The half-down payment is non-refundable. An event is considered booked when Ballroom Surge has received 50% of the rental amount and Ballroom Surge confirms the booking as reserved via email. The half-down deposit will be applied to the total balance. The remaining balance must be paid on or before 14 days prior to the rental date and is non-refundable/non-transferable. Should the event be canceled or postponed, the half-down amount paid is non-refundable, no exceptions. If a rental is canceled at least 30 days prior to the rental date, the half-down amount, and any additional amount paid, can be applied toward another event with Ballroom Surge or anything paid over the half-down deposit can be refunded. Cancellations/transfers must be used no later than 12 (twelve) months after the original scheduled rental date. We allow one date transfer per rental. Transferred rentals are subject to current pricing, so original rental price will not be honored for the transferred date. For date transfers: the full balance will be due at the time of booking to reserve your new date. The total amount paid will be non-refundable and non-transferable. Ballroom Surge has the right to send your balance owed to collections for non-payment. Ballroom Surge does not provide refunds for situations beyond our control such as but not limited to weather or shutdowns issued by the nation/city/state. Ballroom Surge does not give refunds for rentals booked prior to touring to secure a date yet later decide the venue is not a good fit.

Renter shall not hold Ballroom Surge liable for any Covid-19 related issues.

Ballroom Surge reserves the right to cancel your Event at any time and is not required to credit or refund you for any amount paid if your event is cancelled for not following Ballroom Surge guidelines.

RELEASE AND INDEMNIFICATION

RENTER SHALL INDEMNIFY, DEFEND AND SAVE HARMLESS BALLROOM SURGE, ITS OFFICERS, AGENTS AND EMPLOYEES FROM AND AGAINST ANY AND ALL CLAIMS, LOSS, COSTS (INCLUDING ATTORNEYS’ FEES), DAMAGE, EXPENSE, AND LIABILITY (INCLUDING STATUTORY LIABILITY AND LIABILITY UNDER WORKERS’ COMPENSATION LAW) IN CONNECTION WITH CLAIMS, JUDGMENTS, DAMAGES, PENALTIES, FINES, LIABILITIES, LOSSES, SUITS, AND ADMINISTRATIVE PROCEEDINGS RELATED TO THIS AGREEMENT, IRRESPECTIVE OF WHETHER BALLROOM SURGE WAS CONCURRENTLY NEGLIGENT, BUT EXCEPT WHERE THE INJURY WAS CAUSED BY THE SOLE NEGLIGENCE

OF BALLROOM SURGE. THIS INDEMNITY SHALL SURVIVE THE TERMINATION OF THIS AGREEMENT. RENTER HEREBY RELEASES BALLROOM SURGE FROM ANY AND ALL LIABILITY OR RESPONSIBILITY TO RENTER OR ANYONE CLAIMING THROUGH OR UNDER RENTER BY WAY OF SUBROGATION OR OTHERWISE FOR ANY LOSS OR DAMAGE TO EQUIPMENT OR PROPERTY OF RENTER EITHER COVERED OR NOT COVERED BY ANY INSURANCE THEN IN FORCE.
